By using the Barloworld Handling LP (“Barloworld”) web site (“the Site”) for any purpose (including browsing, accessing, buying etc.), you agree to follow and be bound by the following terms and conditions governing your use of the Site as well as our privacy policy. We reserve the right to revise our Terms of Use and Privacy Policy at any time without notice to you.
Use of Site information – Users of the Site may download, view, copy and print documents and graphics incorporated in the site as long as it is solely for personal, informational, non-commercial purposes and the information may not be modified in any way. You may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this Site in whole or in part without the express authorization of Barloworld.

In addition, you may not distribute, publish, transmit, reuse, repost, and frame the content in any manner or sell or attempt to sell the content.

Passwords and Security

You are responsible for maintaining the confidentiality of any password(s) you are given for access to portions of the Site, and are fully responsible for all activities that occur under your password(s). You agree to notify Barloworld immediately of any unauthorized use of your password(s).

Termination

Barloworld may, at its sole discretion, at any time terminate your access to the Site and any account(s) you may have in connection with the Site. Access to the Site may be monitored by Barloworld. You hereby expressly agree to waive any and all claims you may have (whether currently in existence and/or arising hereafter) against Barloworld for any failure by us to enforce this Terms of Use. Barloworld’s failure to act in a particular circumstance does not waive its right to act with respect to that circumstance or other circumstances.

Purchases

When you place orders through the Site, you will be asked to provide certain information about yourself, such as your name, address, and credit card in formation. You may not provide incomplete or inaccurate information (the purchase form will indicate what information is required, and what is optional, and you may also check Barloworld’s Privacy Policy Statement for further information on the collection and distribution of information by Barloworld). You are responsible for any use of this Site by anyone using your credit card number or other identifier. Thus, if for any reason you suspect that your credit card or other identifying information has been compromised, you should contact Barloworld at once.

Privacy Policy Statement

For each visitor to the Site, our server automatically recognizes the consumer's domain name, the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, information volunteered by the consumer, such as survey information, e-mail addresses and/or site registrations. We automatically collect only the domain name.

There are forms on this Site which collect information pertinent to orders you are placing. We use your name, e-mail address, phone number, mailing address, and credit card information to process your orders and/or respond to your requests. This information is stored in a secure database, and is only available to individuals with the proper clearance. To offer our products and services in an efficient manner, Barloworld contracts with third party service providers. These partners provide us with data collection, storage, e-mail/mail support, analysis and reporting services and are restricted from using your information in any way, other than to help us make our site and services more useful to visitors. Service partners are required to sign confidentiality agreements and will abide by Barloworld privacy policies. Additionally, we will share information with law enforcement agencies or other companies assisting us in fraud prevention or investigations. Please note that manufacturers may collect your information from us for warranty or product registration purposes, if applicable. To opt-out of having your personal information available to our service partners, please email CRM@handling.barloworld.com or let us know in writing to the address below.

If you supply us with your postal address on-line you will only receive the information for which you provided us your address. Persons who supply us with their telephone numbers on-line will only receive telephone contact from us with information regarding orders they have placed on-line. The information we collect is used for marketing purposes, internal review, used to improve the content of our Site, but is not shared with other organizations for commercial purposes.

Barloworld will only send information about our promotions or new evolutions from our suppliers to our customers who find it useful. You can opt-out of receiving future communications from us when you set up your account or by updating your account information with Barloworld.

Credit Card Policy

In the unlikely event that your experience unauthorized use of your credit card, promptly report the fraudulent activity to your credit card company. Under the Fair Credit Billing Act, you are only liable for the first $50 of the fraudulent charges. Please check with your credit card company to verify specific terms and conditions.
Barloworld uses Secure Socket layer (SSL) technology for mutual authentication, data encryption, and data integrity to ensure secure transactions for our customers. SSL is the industry standard security protocol to encode sensitive information, such as your credit card number. SSL creates a shared digital key, which only lets the sender and the receiver of the transmission scramble or unscramble information. To everyone else, even the servers relaying the message, the SSL transmission is indecipherable.

Indemnity

As a condition of use of this Site, you agree to indemnify BARLOWORLD HANDLING and its officers, directors, employees or suppliers from and against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of this Site.

General

BARLOWORLD HANDLING reserves the right to make and have made any and all changes to this Site at its sole discretion without notice to the User. Barloworld reserves the right to, at it sole discretion, deny access to this Site to anyone at anytime.

Applicable Laws

All matters relating to your access to, and use of, the Site shall be governed by U.S. federal law or the laws of the state of North Carolina. Any legal action or proceeding relating to your access to, or use of, the Site shall be instituted in a state or federal court in Charlotte, North Carolina. You and Barloworld agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
